What is often you ask

Must a car purchase agreement be notarised?

Under Section 2079 of the Civil Code, notarisation is not mandatory. The contract may be concluded in written form without a notary. Notarisation is recommended when purchasing a more expensive vehicle to provide greater legal certainty.

Who pays the administrative fee when transferring a vehicle?

The administrative fee for transferring the vehicle at the vehicle registry is 100 Kč. It is usually paid by the new owner (the buyer). Both parties may agree otherwise and stipulate this in the purchase agreement.

What if I am selling a car without a valid MOT certificate?

Vehicles older than 40 years are exempt from the MOT test. For others, a valid MOT is recommended. If it is missing, the price should be reduced or an appointment arranged to obtain it.

How long does the seller bear liability for defects?

Under §2099 of the Civil Code, the seller is liable for defects for a period of 24 months from the date of vehicle handover. The parties may agree on a different time limit in the sales contract or waive it entirely.

What are the most common mistakes?

Most common issues: missing or incorrect VIN, inaccurate odometer reading, price not written out in words, missing signatures, vague description of the vehicle's condition, or failure to specify who pays the transfer fees.
